1. Introduction
These Booking Terms and Conditions apply to accommodation reservations made with 730 On Sher (“730 On Sher”, “we”, “us” or “our”).
By submitting, making or confirming a reservation, the person making the booking (“the Booking Guest”) confirms that they:
- have read and understood these Booking Terms and Conditions;
- have legal capacity and authority to make the booking;
- will communicate relevant terms to all accompanying guests; and
- agree that the booking is subject to these Terms.
Nothing in these Terms is intended to waive, reduce or exclude a consumer right that cannot lawfully be waived under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) or other applicable South African legislation.

3. Accommodation
730 On Sher provides short-term accommodation at 730 Sher Street, Garsfontein, Pretoria, Gauteng and/or in the accommodation unit identified in the applicable reservation confirmation.
The accommodation reserved, dates of stay, number of guests, applicable rate and any specifically included services will be recorded in the booking confirmation.
Photographs, descriptions, amenities and other information displayed on the website are intended to describe the accommodation reasonably accurately. Minor changes that do not materially alter the nature or standard of the accommodation may occur from time to time.
4. Making a Booking
An enquiry, submission of an availability form or request for accommodation does not by itself guarantee a reservation.
A booking becomes confirmed only when:
- 730 On Sher has accepted the booking;
- any required deposit or payment has been received or validly authorised; and
- 730 On Sher has issued a booking confirmation.
Until these requirements have been met, availability may remain subject to change.
5. Accuracy of Booking Information
The Booking Guest must ensure that all information submitted is accurate, including:
- guest names;
- contact information;
- booking dates;
- number of occupants;
- accommodation selected; and
- any material special requirements.
730 On Sher must be informed promptly if any material booking information is incorrect or changes.
A booking may not be transferred, resold or commercially assigned to another person without prior approval from 730 On Sher.
6. Prices
The amount payable will be the price communicated and accepted during the booking process or recorded in the quotation or booking confirmation.
Unless expressly stated otherwise:
- prices are quoted in South African Rand (ZAR);
- the rate applies to the accommodation and occupancy specified in the booking;
- additional guests or additional services may incur additional charges where disclosed and agreed;
- applicable taxes and mandatory charges will be dealt with as communicated during the booking process; and
- 730 On Sher will not impose an undisclosed charge contrary to applicable consumer law.
7. Deposit and Payment
730 On Sher may require a reasonable deposit or advance payment to secure accommodation.
The applicable deposit amount, payment deadline and outstanding balance will be communicated before or as part of confirmation of the booking.
A booking may be released where a required payment is not received by the stated deadline, subject to applicable law and the 730 On Sher Cancellation and Refund Policy.
A deposit is not automatically a non-refundable amount. Any amount retained following cancellation remains subject to applicable South African consumer law, including section 17 of the CPA.
8. Electronic and Other Payments
Where payments are made electronically, 730 On Sher may make use of banks, payment gateways or other payment service providers.
Guests must make payments only using payment details or payment channels supplied or confirmed by 730 On Sher.
Guests receiving unexpected banking-detail changes, unusual payment instructions or communications that appear suspicious should verify the information directly with 730 On Sher by contacting +27 82 396 2568 or marsia@730onsher.co.za before making payment.
9. Check-In and Check-Out
Check-in and check-out times applicable to the booking will be communicated in the booking confirmation or arrival instructions.
Alternative arrival or departure arrangements are subject to prior approval and availability.
Early check-in or late check-out may incur an additional charge where that charge has been disclosed and agreed.
10. Identification and Guest Registration
730 On Sher may reasonably request identification or information required to:
- verify a booking;
- comply with applicable law;
- protect guests and property;
- administer access;
- prevent fraud; or
- maintain reasonable security records.
Personal information collected in connection with a booking will be processed in accordance with POPIA and the 730 On Sher Privacy Policy.
11. Occupancy
The maximum permitted occupancy is the number stated for the relevant accommodation or specifically confirmed by 730 On Sher.
No additional overnight occupant may stay at the property without prior approval.
Where additional occupancy is approved, an additional charge may apply where disclosed and agreed.
Overcrowding or deliberate misrepresentation of guest numbers may constitute a material breach of the booking.
12. Children and Minors
The person making a booking must be at least 18 years old and legally capable of entering into the agreement.
Children and minors must be appropriately supervised by a responsible adult.
A minor may not independently occupy accommodation where this would be unlawful or inconsistent with reasonable safety requirements.
13. Guest Conduct
Guests must:
- behave reasonably and lawfully;
- respect neighbours and other occupants;
- comply with reasonable property and security rules;
- avoid excessive noise;
- not cause a nuisance or unreasonable disturbance;
- not deliberately or negligently damage the property;
- not interfere with safety or security equipment; and
- comply with lawful instructions reasonably necessary for safety or management of the property.
Serious unlawful, dangerous or materially disruptive conduct may result in a guest being required to leave the property.
Any cancellation, termination or financial consequence arising from such conduct remains subject to applicable South African law.
14. Parties, Events and Commercial Activities
No party, event, function, commercial shoot, commercial activity or gathering exceeding the confirmed occupancy may be held without prior written approval from 730 On Sher.
Where permission is granted, reasonable additional terms, charges, deposits, occupancy restrictions or noise conditions may apply.
15. Smoking and Vaping
Unless specifically designated otherwise, smoking and vaping inside accommodation areas is prohibited.
Where smoking or vaping causes actual cleaning, deodorising, repair or replacement costs, the responsible guest may be charged the reasonable proven cost required to restore the affected accommodation.
No arbitrary or punitive charge will be imposed merely because it is described as a fine.
16. Pets and Assistance Animals
Pets are not permitted unless expressly approved for the relevant booking or accommodation.
Where a pet is approved, reasonable pet-related rules or charges may apply.
Nothing in these Terms is intended unlawfully to discriminate against a person who requires a legitimate assistance animal.
17. Visitors
Guests are responsible for visitors whom they invite onto the property.
Visitors:
- must comply with applicable property rules;
- may not become undeclared overnight occupants;
- may not cause unreasonable noise or disturbance; and
- may be required to leave where necessary for safety, security or because of serious misconduct.
18. Damage and Breakages
Guests must take reasonable care of the accommodation and all furniture, appliances, fittings, equipment, keys, remotes and access devices supplied for their use.
Any material damage or breakage should be reported promptly to 730 On Sher.
Where a guest or a guest’s visitor causes damage through intentional conduct, negligence or misuse, the Booking Guest may be responsible for the reasonable actual cost of:
- repair;
- replacement;
- specialist cleaning; or
- restoring the affected property.
Normal wear and tear will not be charged.
19. Security or Breakage Deposits
Where a refundable security or breakage deposit is required, the amount will be disclosed before or as part of confirmation of the booking.
Any deduction from a security deposit must relate to a legitimate amount owing by the guest.
Any remaining balance will be refunded within a reasonable time after the accommodation has been assessed.
20. Keys and Access Devices
Guests are responsible for keys, tags, remotes, access cards and access codes supplied to them.
The reasonable actual cost of replacing lost items or re-securing the property where reasonably necessary may be charged to the responsible guest.
Access information may not be distributed to unauthorised persons.
21. Parking
Where parking is provided, guests must:
- use designated parking areas;
- avoid obstructing access or other vehicles;
- comply with reasonable parking and security requirements; and
- take reasonable care of their vehicles and belongings.
Nothing in these Terms excludes liability that cannot legally be excluded.
22. Personal Belongings
Guests remain responsible for taking reasonable care of their personal belongings.
730 On Sher does not accept unrestricted liability merely because loss, theft or damage occurs at the property.
However, nothing in these Terms excludes liability for conduct or circumstances in respect of which liability may not lawfully be excluded under the CPA or another applicable law.
23. Maintenance and Service Interruptions
730 On Sher will take reasonable steps to maintain the accommodation in a suitable condition.
From time to time, interruptions may arise because of matters outside reasonable control, including:
- electricity interruptions;
- water interruptions;
- municipal infrastructure problems;
- telecommunications outages;
- severe weather;
- emergency maintenance; or
- failure of third-party infrastructure or services.
730 On Sher will take reasonable steps appropriate to the circumstances to minimise disruption.
This provision does not remove any statutory right available to a guest under the CPA.
24. Right to Quality Service
Where the CPA applies, guests retain all applicable statutory rights concerning the quality, performance and timely completion of services.
These Terms must therefore be interpreted together with mandatory consumer protections and may not be used to exclude rights that cannot lawfully be excluded.
25. Cancellation by the Guest
Guest cancellations are subject to the separate 730 On Sher Cancellation and Refund Policy, which forms part of these Booking Terms and Conditions.
A cancellation charge may be imposed only to the extent permitted by South African law, including section 17 of the CPA.
The amount of a cancellation charge must remain reasonable having regard to the circumstances of the particular cancellation.
26. Death or Hospitalisation
Where section 17(5) of the CPA applies and the person for whom, or for whose benefit, a reservation was made is unable to honour the booking because of that person’s death or hospitalisation, no cancellation fee will be imposed.
730 On Sher may request reasonable documentary evidence sufficient to establish that the statutory exception applies.
27. No-Shows
A guest who does not arrive for a confirmed booking and who has not provided reasonable cancellation notice may be regarded as a no-show.
A no-show may result in a substantial cancellation charge. Any amount retained must nevertheless remain reasonable under section 17 of the CPA.
28. Changes Requested by the Guest
A request to change:
- booking dates;
- accommodation;
- occupancy; or
- duration of stay
is subject to availability.
A substantial date change may, where reasonable, be treated as cancellation of the original booking followed by creation of a new reservation.
Any financial consequence remains subject to applicable consumer law.
29. Cancellation or Inability to Perform by 730 On Sher
If 730 On Sher is unable to provide confirmed accommodation, the matter will be handled in accordance with applicable South African law.
Where reasonably possible, 730 On Sher may offer:
- comparable alternative accommodation;
- alternative booking dates; or
- an appropriate refund.
Where section 47 of the CPA applies to an overbooking or insufficient capacity situation, statutory remedies available to the guest will be respected.
30. Force Majeure and Events Beyond Reasonable Control
Extraordinary events outside reasonable control may include:
- natural disasters;
- severe weather;
- fire;
- civil unrest;
- government restrictions;
- widespread utility failure;
- serious structural failure;
- public-health restrictions; or
- other events genuinely beyond reasonable control.
The legal and financial consequences of such an event will be determined having regard to the specific booking, services already rendered, South African common law, the CPA and other applicable legislation.
This clause does not automatically permit 730 On Sher to retain the full booking amount whenever an event beyond reasonable control occurs.
31. Website Bookings and ECTA Cooling-Off Rights
The general seven-day cooling-off right contained in section 44 of ECTA does not ordinarily apply to an accommodation service where the supplier undertakes to provide the accommodation on a specific date or within a specific period and the statutory exclusion applies.
This does not remove separate rights available under the CPA.
Where a booking results from direct marketing, any separate statutory cooling-off right that applies under the CPA will be respected.
32. Third-Party Booking Platforms
Where a booking is made through a third-party booking platform, online travel agency or intermediary, the relevant platform’s contractual terms and procedures may also apply.
Guests may be required to process amendments, cancellations or refunds through the platform used to make the booking.
Mandatory consumer rights under applicable South African law are not removed merely because a conflicting platform term exists.
33. Privacy
Personal information associated with enquiries, bookings, payments and stays is processed in accordance with the 730 On Sher Privacy Policy, POPIA and other applicable South African law.

34. Complaints
Guests should notify 730 On Sher of a problem as soon as reasonably possible so that the matter can be investigated and, where reasonably possible, corrected.

Submitting an internal complaint does not remove a statutory right to approach a competent regulator, ombud, tribunal or court.
35. Consumer Goods and Services Ombud
Where the Consumer Goods and Services Ombud has jurisdiction, an eligible consumer may pursue a complaint through the Ombud after reasonable attempts have been made to resolve the matter directly with 730 On Sher.
Nothing in these Terms prevents a consumer from using any dispute-resolution mechanism available under applicable South African law.
36. Limitation of Liability
To the maximum extent lawfully permissible, 730 On Sher will not be responsible for loss that:
- was not caused by a breach attributable to 730 On Sher;
- arises from a guest’s own unlawful or negligent conduct;
- arises from inaccurate or incomplete information supplied by the guest; or
- is too remote to be recoverable under applicable South African law.
Nothing in these Terms excludes, limits or waives liability or consumer rights where such an exclusion or limitation is prohibited by the CPA or another applicable law.
37. Indemnities
No indemnity contained or implied in these Terms is intended to require a consumer to indemnify 730 On Sher against conduct for which South African law prohibits an indemnity or exclusion of liability.
Any indemnity will be interpreted narrowly and consistently with applicable consumer legislation.
38. Notices and Electronic Communications
Communications relating to bookings may take place through:
- email;
- telephone;
- website communications;
- WhatsApp or similar recorded messaging services; or
- another agreed communication channel.
Electronic communications and agreements are not deprived of legal effect merely because they are in electronic form.
39. Governing Law
These Booking Terms and Conditions and all bookings made with 730 On Sher are governed by the laws of the Republic of South Africa.
Nothing in this clause prevents a consumer from relying upon any jurisdictional or other right conferred by applicable consumer legislation.
40. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or severed only to the extent necessary.
The remaining provisions will continue to apply where legally possible.
41. No Waiver of Statutory Rights
If any part of these Terms conflicts with a mandatory provision of South African law, the mandatory provision will prevail.
A guest’s failure to enforce a right immediately does not automatically constitute a permanent waiver of that right.
42. Amendments
The version of these Booking Terms and Conditions accepted when a booking is concluded will ordinarily govern that booking.
Later amendments will not retrospectively impose materially more onerous conditions on an already concluded booking unless there is a lawful basis for doing so.
